There's a verdict in the murder trial of the Rochester man accused of fatally shooting his nephew in October.
In a bench trial in Monroe County Court, Judge John DeMarco found Vinh Dac Phan, 55, guilty of second degree murder.
Police testified that Phan fatally shot his nephew Ho Tai, 32, several times at close range on Veterans Place in the South Wedge.
Family members say the Oct. 6, 2012 shooting was the result of a family argument over custody of Ho Tai's child.
During the seven-day trial, the defense did not deny that Phan shot his nephew, but argued that he suffered from extreme emotional disturbance.
Phan faces a maximum sentence of 25-years to life in prison when he is sentenced Feb. 12.
